Terms and Conditions for the nym.ink network
These terms of use govern your use of the sites in the nym.ink network. If you do not accept these terms of use, please do not use these sites. Your continued use of this site confirms your acceptance of these terms.
WEB SITE ACCESS
It is not necessary to register with us in order to use most parts of the nym.ink network. However, particular areas of the nym.ink network will only be accessible only if you have registered.
USE OF WEBSITE
The nym.ink network may be used for your own private purposes and in accordance with these terms of use.
You may print and download material from the nym.ink network provided that you do not modify or reproduce any content without our prior written consent.
SITE UPTIME
All reasonable measures are taken by us to ensure that the nym.ink network is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if any of our sites are unavailable at any time.
Where possible we always try to give advance warning of maintenance issues that may result in down time but we shall not be obliged to provide such notice.
VISITOR PROVIDED MATERIAL
Any material that a visitor to the nym.ink network sends, emails, or posts to our sites shall be considered non-proprietary and non-confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us.
When using the nym.ink network you shall not post or send to or from the nym.ink network any material:
1. for which you have not obtained all necessary consents;
2. that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in Canada;
3. which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.
LINKS TO AND FROM OTHER WEBSITES
Throughout the nym.ink network you may find links to third party websites. The provision of a link to such a website does not mean that we endorse that website. If you visit any website via a link on the nym.ink network you do so at your own risk.
Any party wishing to link to any of the sites in the nym.ink network is entitled to do so provided that the conditions below are observed:
1. you do not seek to imply that we are endorsing the services or products of another party unless this has been agreed with us in writing;
2. you do not misrepresent your relationship with the nym.ink network; and
3. the website from which you link to the nym.ink network does not contain offensive or otherwise controversial content or, content that infringes any intellectual property rights or other rights of a third party.
By linking to the nym.ink network in breach of our terms and conditions, you shall indemnify us for any loss or damage suffered to the nym.ink network as a result of such linking.

Whilst we do take all reasonable steps to make sure that the information on the nym.ink network is up to date and accurate at all times we do not guarantee that all material is accurate and, or up to date.
All material contained on the nym.ink network is provided without any or warranty of any kind. You use the material on the nym.ink network at your own discretion.
EXCLUSION OF LIABILITY
We do not accept liability for any loss or damage that you suffer as a result of using the nym.ink network, including for any indirect, special or consequential loss, or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
Restricted access
Access to certain areas of this website is restricted. We reserve the right to restrict access to other areas of the nym.ink network.
If we provides you with a user ID and password to enable you to access restricted areas of any of our sites or other content or services, you must ensure that the user ID and password are kept confidential.
We may disable your user ID and password in our sole discretion without notice or explanation.
USER CONTENT
In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to the nym.ink network, for whatever purpose.
You grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights.
Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or the nym.ink network or a third party (in each case under any applicable law).
You must not submit any user content to the nym.ink network that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
We reserve the right to edit or remove any material submitted to the nym.ink network, or stored on our servers, or hosted or published upon the nym.ink network.
Notwithstanding our rights under these terms and conditions in relation to user content, we do not undertake to monitor the submission of such content to, or the publication of such content on the nym.ink network.
